Welcome to InGain LLC. These Terms and Conditions ("Terms") govern your use of our website (https://www.ingainllc.com) and the purchase of our coffee products and services. By accessing our site or placing an order, you agree to be bound by these Terms.

1. Eligibility (B2B & B2C)

InGain LLC serves both business entities (roasters, wholesalers, retailers) and individual physical entities (B2C). There are no restrictions on who may purchase our coffee, provided they agree to these Terms and comply with applicable import/purchase regulations.

2. Products and Samples

  • Product Range: we supply both Green Coffee Beans and Roasted Coffee in various volumes.

  • Sampling: Customers are encouraged to order samples to conduct their own testing and sensory evaluation prior to placing a bulk or wholesale order.

  • Specifications: While we strive for consistency, coffee is an agricultural product; minor variations between samples and bulk lots may occur within industry-standard tolerances.

3. Quality Control and Inspections

To ensure transparency and quality, we utilize one or more of the following verification methods:

  • Third-Party Inspections: We may provide reports from internationally recognized bodies such as SGS, Bureau Veritas, or other accredited third-party inspectors.

  • On-Site Verification: Our team may conduct physical inspections on-site by visiting suppliers directly during shipment arrangements.

  • International Test Hub: At our discretion, quality checks may also be conducted at our facility in Yerevan, Armenia.

4. Importer of Record (IOR) & Compliance

InGain LLC acts as the Importer of Record (IOR) for shipments entering the United States.

  • Our Role: We manage the legal entry of goods and necessary FDA documentation at the port of entry.

  • Support: We offer our expertise to support customers for a smoother compliance experience.

  • FSVP Clarification: Unless explicitly contracted otherwise, InGain LLC is not the designated Foreign Supplier Verification Program (FSVP) importer for the customer.

5. Shipping, Incoterms, and Risk

We do not offer DDP (Delivered Duty Paid) terms. All shipments are conducted under the following Incoterms: CIP, CIF, FCA, FOB, CPT, or CFR.

  • Transfer of Risk: Risk of loss transfers from InGain LLC to the buyer upon delivery to the buyer’s specified port of entry.

  • Customs Clearance: If InGain LLC is performing customs clearance, the risk of loss transfers upon delivery to the buyer’s specified warehouse facility following clearance.

6. Payments and Invoicing

  • No Online Storefront Payments: InGain LLC does not accept payments directly through the website interface.

  • Payment Methods: All orders are processed via professional invoices. Payment is accepted via Bank Transfer (Wire/ACH) or secure card payments processed through external, secure links provided by our team.

7. Intellectual Property

All content on ingainllc.com, including technical coffee profiles, origin descriptions, and the "InGain LLC" brand, is the intellectual property of InGain LLC. Unauthorized use of these materials is strictly prohibited.

8. Limitation of Liability

InGain LLC shall not be liable for indirect or consequential damages resulting from shipping delays, international freight disruptions, or regulatory changes at the port of entry. Our total liability is limited to the amount paid for the specific order in question.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA.
